Litigation Management

What is Litigation Management and why do you need it?

Before starting a litigation you should not only assess the legal aspects of your case. Under many circumstances the purely legal obstacles form only the smaller part of the process. In particular in supposingly "straightforward" cases such as debt collection on trade debt, the material legal aspects are often a no-brainer. The real problems of such cases lie more often with very practical aspects such as:

If I win the case, will I ever be able to collect?

How much do I have to spend on the litigation and is it worth the effort, or am I throwing good money after bad?

How much internal effort will it cost me to instruct and supervise the attorney of my choice?

The case itself is straightforward, but how do I find the debtor who is on the run?

How do I find possible assets for enforcement?

These issues are rarely dealt with by the average law firm, even if a local law firm might be the economically preferably option instead of a multinational (also the latter will not necessarily take the aspects mentioned above into due consideration. Used to dealings with multinationals, they often lack the practical experience of chasing the average fraudster). This is where Litigation Management can help you to improve the efficiency and effectiveness of your actions and to keep your budget under control.

When litigating in a foreign country the complexity factors mentioned above are multiplied by several times. International litigation often results in a strongly increased incurrence on fees and expenses. To avoid these inherent traits it must be ensured that organization and efficiency are maximized.

You need to find the best local counsel possible.

Accurate information, briefing and a sound litigation plan are mandatory to prevent waste of precious financial resources.

You need to brief your lawyers in the most efficient manner, using their precious and costly time only on legal matters and not burdening them with fact finding and document collection. Although of course they will gladly provide to you these administrative services as well, at their regular hourly fees. Instead of providing those with tons of documents which they need to work through, you need someone who can pinpoint to your counsel the relevant information and deal with the irrelevant.

We have the experience to help you manage any commercial and fraud litigation in almost all of Europe. Therefore, before embarking on a litigation process, contact us in order to find out where we can save your money and effort.
